Buying property in India is one of the biggest financial decisions you'll make. With 66% of all court cases in India being property-related disputes, thorough document verification isn't optional — it's essential.
Essential Documents to Verify
1. Title Deed / Sale Deed
The most critical document. Verify: the seller is the actual owner, the property description matches what you're buying, there are no encumbrances, and the deed is properly registered at the Sub-Registrar's office.
2. Encumbrance Certificate (EC)
Obtain an EC for the last 30 years minimum. This shows all registered transactions on the property — mortgages, liens, and disputes. Any gaps in the EC period are a red flag.
3. Khata Certificate / Patta
This proves the property is registered in the municipal records and that property tax is being paid. The name on the Khata/Patta should match the seller.
4. Property Tax Receipts
Verify that property tax has been paid up to date. Unpaid taxes can become your liability after purchase.
5. Building Approval Plan
For flats/buildings, verify that the construction was approved by the local municipal authority. Unauthorized constructions can be demolished.
6. Occupancy Certificate (OC)
This certifies the building is fit for habitation and complies with building codes. Without an OC, you may face issues getting utility connections.
7. RERA Registration (for new projects)
Under the Real Estate (Regulation and Development) Act 2016, all new projects must be registered with the state RERA authority. Verify the RERA number on the state portal.
State-Specific Requirements
Each state has additional requirements. For example, in Karnataka you need a Betterment Charges receipt, in Maharashtra you need a Society NOC for resale flats, and in Tamil Nadu you need a Patta transfer.
